Seniors are at the center of the drug pricing crisis. Nearly 9 in 10 Americans over the age 65 take prescription medications, with many struggling with serious conditions such as diabetes, arthritis, and cancer. As many as one in four seniors, or more than 10 million seniors nationwide struggle to afford prescription drugs, with higher rates among more vulnerable groups, including low-income seniors, people of color, and those in poor health. It is unconscionable that seniors and older adults in this country are forced to make impossible choices between purchasing essential medicines and buying food or paying rent. 

Yet every day, drug companies profit off of seniors. Drugmakers are raking in record profits and spending millions on lobbying to block reform while continuing to hike the prices of lifesaving medications. A recent analysis from the Kaiser Family Foundation found that half of all drugs covered by Medicare Part D, or 1,646 drugs, had price increases averaging 3.5 times the rate of inflation between 2018 and 2019. This translates to hundreds, if not thousands, in additional out-of-pocket costs for patients — simply unworkable for seniors with fixed incomes. Research shows that even a modest increase in out-of-pocket costs can have deadly consequences for patients, who are forced to skip doses or forgo medications altogether due to rising costs. 

High drug prices demonstrate the urgent need to give Medicare the power to negotiate for lower drug prices. In 2019, the House of Representatives passed the Lower Drug Costs Now Act (H.R. 3), historic legislation that would lower drug prices for all patients, not just those covered under Medicare. H.R. 3 would save patients over $150 billion and reduce the price of the costliest drugs by as much as 55 percent. 

Not only does giving Medicare the power to negotiate help seniors at the pharmacy counter, but it would save the federal government nearly $500 billion, which could be reinvested to strengthen health care for seniors and older adults. These savings could help lower premiums, expand coverage, establish an out-of-pocket cap for drug costs, and strengthen Medicare benefits to include hearing, vision, and dental. As the nation recovers from the coronavirus pandemic, ensuring access to affordable health care, and specifically prescription drugs, has never been more critical.

    • Millions of seniors are struggling to afford medications as drug companies are raking in major profits. 89 percent of Americans over 65 take prescription medications, with one in four struggling to afford drug costs. Meanwhile, pharmaceutical companies are experiencing record profits and breaking records for the money they are spending on K Street lobbyists to block legislation to lower prices for seniors. Research shows Big Pharma could lose $1 trillion in sales and still be the most profitable industry. 
    • Despite record profit, drug manufacturers continue to exploit a broken system by hiking prices at the expense of our seniors. In January 2021, drugmakers hiked the price of nearly 1,000 drugs. Between 2018 and 2019, 1,646 drugs covered by Medicare Part D experienced price increases averaging 3.5 times the rate of inflation. These surging drug costs are particularly difficult for the 50 percent of Medicare beneficiaries living on annual incomes below $29,650
  • Growing out-of-pocket drug costs put the lives of seniors at risk. Medicare has no cap on out-of-pocket prescription drug costs. A 2021 study found that increasing out-of-pocket drug costs by only $10 created a 33 percent increase in mortality, due to a decrease in medication accessibility. Biogen’s debut of Aduhelm, a new Alzheimer’s treatment slated to cost $56,000 per year with over $10,000 in out-of-pocket costs to patients, demonstrates the reckless greed of the pharmaceutical industry. 
  • Americans don’t trust Big Pharma to play fair. Nearly 75 percent of Americans do not trust drug manufacturers to set fair pricing for prescription drugs and nine in ten believe the federal government should have the power to negotiate with drug companies to lower the price of prescription drugs for Medicare recipients. 

Rising Prescription Drug Costs Disproportionately Impact Seniors

Nearly Nine In Ten Seniors Currently Take Prescription Medication, With Millions Struggling To Afford The Cost. One in four adults over 65 report difficulty affording their prescription drugs. Seniors most likely to experience difficulty are: in poor health, have an annual household income under $30,000, and/or take four or more prescription medications. 

Prescription Drug Prices Continue To Outpace Inflation. Between 2018 and 2019, 1,646 drugs covered by Medicare Part D experienced price increases averaging 3.5 times the rate of inflation.

The Most Essential Medications Are Often The Most Expensive. With the high cost of specialty medications, it should come as no surprise that 80 percent of prescriptions that seniors report struggling to afford are for the treatment of ‘somewhat serious’ or ‘very serious’ health conditions. One million Medicare Part D beneficiaries spend more than Part D’s catastrophic coverage threshold, paying an annual out-of-pocket average of $3,200. Patients taking prescription drugs for treatment of cancer, hepatitis C, multiple sclerosis, and rheumatoid arthritis face some of the most extreme costs. The average out-of-pocket cost for 11 oral prescription cancer drugs was $10,470 in 2019. 

Most Medicare Beneficiaries Live On A Fixed Income. In 2019, 50 percent of Medicare recipients had incomes under $29,650. With average out-of-pocket costs for specialty medications surpassing $8,000, many seniors are faced with the impossible decision of filling their prescriptions or paying for other basic needs. 

Growing Out-Of-Pocket Prescription Costs Limit Medicare Beneficiaries’ Access To Drugs

Medicare Has No Out-Of-Pocket Limit For Prescription Drugs. Individuals on Medicare are the only insured Americans to have no cap for out-of-pocket medication costs. Once Medicare beneficiaries are out of the coverage gap and have obtained catastrophic coverage, they are still responsible for coinsurance and copayments costs.

Out-of-Pocket Costs For Specialty Medications Are Skyrocketing. Even with catastrophic coverage, Medicare Part D enrollees can face thousands of dollars in out-of pocket expenses for specialty drugs. Kaiser Family Foundation anticipated the average 2019 out-of-pocket cost for specialty drugs to be $8,109

High Out-of-Pocket Costs Force Seniors To Forgo Medications. One in five seniors report not taking their medications as prescribed due to cost. A 2021 study found that increasing out-of-pocket costs by only $10 created a 23 percent decrease in Medicare beneficiaries taking prescription drugs as instructed, as well as a 33 percent increase in mortality. 

Seniors Are Forced To Put Off Retirement To Access Needed Drugs. Without a limit on out-of-pocket costs for prescriptions, many older Americans continue working to retain access to employer insurance plans which offer additional coverage. Postponing the transition to Medicare also allows for the continuation of financial assistance from pharmaceutical manufacturers, not available to Medicare beneficiaries.

Americans Don’t Trust Big Pharma And Support Efforts To Bring Down Drug Prices 

Americans Hold Big Pharma Responsible For High Costs. 80 percent of Americans believe the profits of drug manufacturers are a leading contributor to the unreasonably high price of prescription medication. As a result, nearly 75 percent of Americans do not trust pharmaceutical corporations to set a fair price for their prescription drugs. 

Seniors Want Action From Congress. 82 percent of seniors support the federal government negotiating lower prescription drug prices for Medicare recipients and nearly 70 percent favor an annual cap on out-of-pocket drug costs for those on Medicare.

There Is Strong Support For Drug Price Negotiation. Nine in ten Americans agree the federal government should have the power to negotiate with drug companies to lower the price of prescription drugs for Medicare recipients. 

Seniors Support Basing Drug Prices On Amounts Paid In Other Countries. 60 percent of older Americans favor tying what Medicare pays for prescription drugs to the amounts paid by other countries. The CommonWealth Fund found that H.R. 3 would create a maximum price for any negotiated drug by tying it to the cost in other countries and penalizing manufacturers who fail to agree to prices set by HHS.

IN THE NEWS: Supreme Court Upholds Affordable Care Act for the Third Time After Failed Trump-Republican Lawsuit

Last week, in an 7-2 ruling in California v. Texas, the Supreme Court delivered a massive repudiation of the Republican war on health care. By throwing the lawsuit out on standing, the court protected the health care coverage of more than 20 million Americans and prevented more than 135 million people with pre-existing conditions from losing the protections they rely on, and many other key ACA provisions. The lawsuit was former President Trump and his Republican allies’ last-ditch effort to dismantle the ACA after they failed to do so in Congress. 

The court’s decision to affirm the ACA should mean the end of the road for Republicans’ relentless attacks on the law. Press coverage makes clear that the ruling creates momentum for President Biden and the Democratic majorities in Congress’ to build on the ACA to further expand coverage, lower costs, and reduce disparities in care.   

To celebrate the victory for millions of American families and hold Republicans accountable for their attack on health care, Protect Our Care hosted a national press call and events in Alaska, Arizona, Florida, Georgia, Maine, North Carolina, Ohio, and Wisconsin last week.

The Hill: Supreme Court Upholds ObamaCare In 7-2 Ruling. “’The Supreme Court Has Spoken: The Affordable Care Act Is the Law of the Land,’ was the title of a statement from the Democratic group Protect Our Care, founded to fight GOP repeal efforts in 2017. The decision ‘brings to an ignominious close a decade of Republican attacks on American health care,’ the group said.” [The Hill, 6/17/21]

New York Times: Republicans Wave The White Flag On Health Care (for Now). “‘Hopefully, this will be the end of the line,’ said Brad Woodhouse, the executive director of the liberal group Protect Our Care and one of many Democrats who took a victory lap after the Supreme Court’s ruling on Thursday. ‘If Republicans continue to do this, they are likely to continue to lose elections on this issue’.” [New York Times, 6/18/21]

NBC News: Supreme Court Ruling on Obamacare Brings Relief, Hope to Patients. “Leslie Dach, who was a senior counselor at the Department of Health and Human Services during the Obama administration, founded the liberal group Protect Our Care to defend the law’s public image and fight the many legal challenges against it. He said that the group will continue the efforts but that it is refocusing its energies to push to make the American Rescue Plan subsidies permanent, create a federal solution to expand Medicaid in resistant states and lower the price of drugs. ‘We’ve been arguing for this agenda, as have others, because we have this once-in-a-decade opportunity to move forward,’ Dach said, ‘but this now clears the path and hopefully puts the wind in the back of those sails’.” [NBC, 6/17/21]

The Palm Beach Post: Florida Democrats Hail Supreme Court Obamacare Ruling That Deals GOP Defeat. “A years-long legal battle waged against the Affordable Care Act by Republican leaders in states such as Florida ended in a resounding defeat Thursday. The Supreme Court ruled 7-2 against a legal challenge filed by the Trump administration to void the law. Instead, the high court left the law, known broadly as Obamacare, intact and in place. Gongwer Ohio: Ohioans Weigh In After High Court Again Allows Obamacare To Stand. “The nation’s highest court on Thursday declined for the third time to strike down the Affordable Care Act. Today, the Supreme Court delivered a massive repudiation to the Republican war on health care by throwing California v. Texas, the Trump-backed lawsuit seeking to overturn the Affordable Care Act, out on standing. Statements from Democratic leaders and health care advocates make clear that the decision to affirm the ACA only increases the momentum behind President Biden’s and Democrats as they work to deliver on their health care agenda that voters across the political spectrum support. Washington, DC — Today, in a massive repudiation of the Republican war on health care, the Supreme Court ruled to uphold the Affordable Care Act in California v. Texas, a lawsuit brought by 18 Republican-led states and backed by the Trump administration, seeking to completely dismantle the health care law. By upholding the ACA, the court saved health coverage for more than 20 million Americans and protections for more than 135 million people with pre-existing conditions, along with many more critical provisions. The decision brings to an ignominious close a decade of Republican attacks on American health care and provides significant momentum to efforts by President Biden and Congressional Democrats to build on the health care law by expanding coverage, lowering costs and addressing racial disparities in care and coverage.   

“Today’s decision is a tremendous victory for the American people and a complete repudiation of the Republican war on health care. Republicans have waged a years-long battle to undermine the Affordable Care Act and rip coverage from millions of Americans, and it has cost them Congress and the White House. Phoenix, AZ — Today, Arizona Alliance for Retired Americans and a local Arizona health care advocate joined Protect Our Care Arizona for a virtual press conference to announce Protect Our Care’s new digital ad in Arizona — part of a seven-figure ad campaign about prescription drug prices. The ad features Beatriz Morrison, a patient storyteller from Phoenix who is struggling to afford her prescriptions. In the ad, Morrison tells her personal story and relays the importance of giving Medicare the power to negotiate with drug companies for lower prices for all Americans. 

“I either have to cut back on a utility or I have to cut back on my groceries,” said Morrison. “Well, right now I’ll be truthful. I’m only taking medication for my heart. I have Lupus. I have Sjögrens. I have Glaucoma. I have Rheumatoid Arthritis. And I’m only taking medication for my heart.”

The ad is part of the national Campaign to Reduce Drug Prices, a grassroots and communications campaign calling for comprehensive legislation to lower drug prices. The ad will run on digital platforms, focusing particularly on older Americans, beginning on June 15. Protect Our Care will continue to run ads and host events both nationally and in 13 key states, including Arizona, throughout the summer.

“I’m angry because Beatriz is not the only one in Arizona and this country that is living like this,” said Saundra Cole, President of the Arizona Alliance for Retired Americans. “It’s not right. The AARA is trying to get the word out to our elected officials that we built this country and we now we can’t even afford our prescriptions. We need our elected officials to protect us and to advocate for us. That’s what we elect them to do. We are just asking that we are able to pay for our own medication.”

Arizonans support prescription drug reform because they feel the impact of the high costs of their medications firsthand. HEADLINES: Aducanumab Highlights Need To Address Soaring Specialty Drug Prices

Last week, the FDA approved the sale of an Alzheimer’s drug, Aducanumab, despite mixed results during its clinical trials and remaining questions about dangerous side effects. Coverage continues to confirm that the drug’s price tag of $56,000 a year will have massive consequences for patients, taxpayers, and the entire health care system. 

Millions of seniors are expected to qualify for this medication, but the drug’s price is double the average income of a person on Medicare. Drugs can only help patients if they can afford them. Patients could be left on the hook for thousands of dollars in out-of-pocket costs while they are grappling with a devastating disease. Even the Alzheimer’s Association called the price of the drug “simply unacceptable.” Aducanumab shines a bright light on Big Pharma’s endless greed and the rigged system that allows drugmakers to set prices for drugs without limits. It also demonstrates the urgent need for giving Medicare the power to negotiate for lower prices.

Protect Our Care and Arizona Advocates to Announce First Ad in Seven-Figure Campaign Featuring Patient Who Needs Action To Lower Drug Prices

Phoenix, AZ — On Wednesday, June 16 at 11:00 AM MT // 2:00 PM ET, Arizona Alliance for Retired Americans and a local Arizona advocate will join Protect Our Care Arizona for a virtual press conference to announce Protect Our Care’s new digital ad in Arizona — part of a seven-figure ad campaign about prescription drug prices. The ad features Beatriz, a patient storyteller from Phoenix who is struggling to afford her prescriptions. In the ad, Beatriz tells her personal story and relays the importance of giving Medicare the power to negotiate with drug companies for lower prices for all Americans. 

The ad is part of The Campaign to Reduce Drug Prices, a grassroots and communications campaign calling for comprehensive legislation to lower drug prices. The ad will run on digital platforms, focusing particularly on older Americans, beginning on June 15. Protect Our Care will continue to run ads and host events both nationally and in 13 key states, including Arizona, throughout the summer.
